The Himachal High Court has issued notices to the state authorities on a public interest litigation (PIL) alleging large-scale unauthorised construction, environmental degradation, illegal land transactions and violations of Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972, in Kheel Koron, Kainthari, Padgyani, Barog, Kumarhatti and adjoining areas of Solan district.

    A Division Bench comprising Chief Justice Gurmeet Singh Sandhawalia and Justice Bipin Chander Negi directed the Principal Secretary (Revenue) to constitute a team of senior Forest Department officers to inspect the affected areas and submit a report on whether there had been any reduction in green cover, whether trees were officially marked before felling and, if not, the reasons for the same.

    The PIL, filed by Earth Healers Foundation, seeks the constitution of a high-level Special Investigation Team (SIT) to probe allegations of benami transactions, illegal acquisition of land, unauthorised hill cutting, encroachments and environmental violations. It also urges the state to notify the affected areas as Planning Areas or Special Areas under the Himachal Pradesh Town and Country Planning Act, 1977.

    While hearing the matter, the court observed that photographs placed on record indicated extensive hill cutting, removal of green cover and large-scale construction activity. It also noted stacks of cut timber at the sites, raising concerns over possible illegal felling of trees and the apparent inaction of the Forest Department.

    The Bench also took note of allegations regarding illegal borewells being used to supply water for construction as well as domestic and commercial purposes, observing that the issue required examination.

    Referring to its earlier orders in CWPIL No. 13 of 2021, the court reiterated that no construction beyond six floors would be permitted in the area and directed the Town and Country Planning Department, Solan, to ensure compliance. The matter has been listed for further hearing on August 17.
